November 1854

Estate of James Everhart decd.

         Emanuel Everhart Petition for Letter admrs.

And now comes Jane (ink smeared not clear) Everhart, and it appearing to the satisfaction of the court that Legal notices had been given, and no objection having been filed in this court.  It is therefore ordered by the court that the said Emauel Everhart be and he is hereby appointed administrator of the Estate of said James Everhart deceased, & that letters issued.  It is further ordered that said Emanuel Everhart enter into bond in the sum of Five thousand dollars Subject to approval at next Term of this Court.

         It is further ordered that R. E. Montgomery, James Batsel, and Michael Pitman be and they are appointed appraisers of the property belonging to said Estate.

December Term AD 1854

Estate of James Everhart and          } Petitions to

             Emanuel Everhart Admr      }  Sell personal property

And now comes Emanuel Everhart administrator of the Estate of James Everhart deceased and presented his Petition asking for an order authorizing him to sell the personal property belonging to said Estate.  It is therefore ordered that said administrator give legal notice and sell all the Stock and other personal property belonging to said Estate on a credit of twelve months  (except that – ink smeared not clear) the widow of said deceased may wish to retain as part of her allowance.

Ordered by the court that Emanuel Everhart administrator of said James Everhart decd. Be allowed until next Term of Term of the court to make Report of Inventory and Sale Bill of Property belonging to said Estate.

         It is further ordered that said Administrator be permitted to sell an improvement or claim as Siminary land at private sale.

Ordered that this cause be continued until next Term of this court for Report of Inventory and Sale Bill of property belonging to said Estate.

         March Term 1855

           Emanuel Everhart admr.        } Sale Bill No. 1

                                                Credit of note

Now comes Emanuel Everhart admr of the Estate of  James Everhart deceased and presented to the court an appraisment of the property belonging to the Estate of said deceased, which was approved and ordered to be filed and Recorded.

         And the Said Administrator also presented a Sale Bill of the personal property belonging to said Estate which was approved and ordered to be filed and recorded.

         And said administrator presented to the court an affidavit of James Kidd showing that said Kidd had paid a certain note payable to said deceased in his life time.  It is ordered that the said admr be allowed credit for $23 the amt of said note & that said aft be sufficient voucher for said admr.

Ordered by the court that Emanuel Everhart admr of the Estate of James Everhart decd. Pay over to the widow of said deceased the sum of two hundred dollars for the support of the widow and children of said decedent for one year.

Ordered that Said Administrator have until next term of this court to file his annual Report & Exhibit.

Now on this day E. Everhart presented his annual Report Showing the true situation of said Estate which was approved and ordered to be filed.

Emanuel Everhart               }on Bond

  James Everhart deceased     }

         And now at this time comes the aforesaid parties and the Defendant having accepted service of process by writing on Plantiffs Petition and it appearing to the court that the land sued for by plantiff were sold by the said deceased in his life time as appears by a Bond signed by the said James Everhart conditioned  etc. and it further appearing that the said James Kidd has fully complied on his part with said conditions and fully paid the purchase money etc.  It is therefore ordered adjudged and decreed that the said Emanuel Everhart as said admr proceed to Execute a deed to the said James Kidd for the land mentioned & described in said Bond.  It is further adjudged and Decreed that all the right and title to said land heretofore held and possessed by the said James Everhart be fully completely and forever vested in the said James Kidd.

Ordered that this cause be continued until next Term of this court for explanation of Exhibit.

And now comes said Everhart admr as aforesaid and presented to the Court his Exhibit & vouchers for final settlement and it appearing to the court that Legal Notice had been giving and no objections having been filed in this Court and said exhibit having been examined and found correct in all things which said Report was approved and ordered to  file and it further appearing from said Report that the Assetts belonging to said Estate amount to the sum of $2173.661/2 cts and that the legal claims against said Estate amount to $1367.91 leaving a balance in the hands of said administrator in favor of said Estae in the sum of $605.75 cts.
