Oil Lease From Hull & Brother Main, between 4th and 5th up stairs.

This Indenture made this 23rd day of October A.D. 1865 between Thomas Everhart of the county of Hawkins State of Tennessee of the first part, and John M. Fraim & Co of the county of Monroe and State of Kentucky of the second part, witnesseth:

That the said party of the first part, for a valuable consideration does hereby grant and lease unto the said parties of the second part, their executors, administrators and assigns, the sole and exclusive right to all the Oil, Coal, Salt, or other minerals, in upon or under a certain tract or piece of land in the county of Hawkins State of Tennessee Bound on the East by George Setarr? the west by Thomas & Joseph Rogers, on the North by George Holis? heirs Lying on Poor Valley Creek for the term of Fifty years together with the right, during said term to enter upon the said land and occupy so much of the surface as shall be necessary to carry on the operations of boring or mining for the said oil or other minerals collection and storing the same and preparing the same for market including and paying therefor unto the party of the first part, heirs and assigns, The one Tenth part of all the oil or other minerals ______ upon the premises, in good and marketable condition each party to furnish barrels for his, her or their own share of oil. It is also agreed that the parties of the second part shall have the timber that may be necessary for their operation of engine _______, derricks, and framework for putting down wells; and fire wood sufficient for running the engines until said wells are completed The parties of the second part shall also have the right to remove their engines, pipes, tools, ropes and machinery whatever, whenever they shall choose to abandon operations and it is further agreed that the parties of the second part shall have the right of way to and from their place of work, such right of way not to interfere unnecessarily with buildings or farming operations and it is further agreed, that as soon as the parties of the second part shall have fully explored and tested the said land to their satisfaction, they shall abandon the same and the lease shall then be null and void & as if it had never been made.

On this 25th day of October A D 1865 before me the subscribed personally appeared said Lafayette Harling and J. W. Counts the subscribing witnesses and made oath _____ form of law and say that they saw Thomas Everhart & John M. Fraim & Co. sign the above named & secondly acknowledge the foregoing Indenture to be their act and deed for the purposes therein mentioned and desired the same might be accorded as such.
