James M. Hord To Thomas Everhart

Registered the 16th day of March 1866 at 12 oclock m.

This indenture made this 25th day of Oct the year of our Lord One Thousand Eight hundred and fifty nine between James M. Hord of the one part and Thomas Everhart of the other part Witnesseth both of the county of Hawkins and State of Tennessee witnesseth that the said James M. Hord for and in consideration of the sum of two hundred and fifty dollars to him in hand paid by the said Thomas Everhart the receipt whereof is hereby acknowledged doth give grant bargain and sell alien ______ convey and confirm with the said Thomas Everhart his heirs and assigns a certain tract piece parcel of land situate lying and being the county aforesaid on the north side of Holson river on both sides of Big Poor Valley Creek bounded as follows to wit Beginning on a spruce pine thence north Eleven degrees East forth two poles to a poplar stump thence north twenty five degrees East three hundred and six poles to a poplar and chestnut oak then south twenty degrees East two hundred and ninety poles to a Stake thence South sixty degrees west one hundred and ten poles to a chestnutt oak thence north Eighty degrees west one hundred and fifty eight poles to the Beginning containing by estimation two hundred and seventy one acres by the same more or less. To have the said tract piece or parcel of Land with all and singular the improvements heredetiments and appurtenances thereto belonging or in any wise appertaining to him the said Thomas Everhart his heirs and assigns to his and their only proper use benefit and behalf for over And the said James M. Hord for himself his heirs executors and administrators doth covenant promise and agree to and with the said Thomas Everhart his heirs and assigns that the Title to the above described tract or parcel of Land he and they will _______ and forever defend against the title claim and demand of all and every person or persons whatsoever setting up title to the same either in Law or Equity.

State of Tennessee Hawkins County } Personally appeared before me James H. Vance clerk of the county court of said county the within named James M. Hord with whom I am personally acquainted and acknowledged that he executed the forgoing deed for the purposes therein contained.
