We Alexander Hail, John Hail and Augmun Hail have this day Bargained and sold and do hereby transfer and convey to Nicholas Everhart and his heirs and assigns forever for the consideration of one thousand dollars to us paid, Two tracts of land in the State of Teeenssee and Greene County, on the South side of Bays Mountain, on the waters of Gap Creek, Known as the place where William Brotherton and Harvey Hail decd Joining Lands of the heirs of Peter Couch, George Kenney, Alexander Williams and John Couch & Bounded as follows. BEGINNING at a small hickory, ash and white oak, corner to John Couch Junr. and running with his line, South thirty one and a fourth degrees West. Eighty three poles to a stone corner to said Couch thence south forty seven degrees East, twenty eight poles to a hickory & corner to George Kenney, thence with his line south sixty five degrees East one hundred and sixty poles to a beech on the side of the Mountain, thence with Williams line, North twenty two degrees East, twenty eight poles to a Beech bounded by the Mountain, thence with the same North eight degrees east, ninety poles to a sugar tree thence North twelve Degrees East, twenty four poles to a Beech on the Bank of the creek, on Couch's line thence with the same West one hundred and Eighty nine poles to the Beginning, containing by estimation one hundred and forty seven acres, be the same more or less. -- Also one other tract BEGINNING at a post oak on the top of the Pilot Ridge Running thence South fifty one Degrees East fifty poles to a post oak and hickory, thence South thirty four West, two hundred and forty six poles along Hardin's old line to a white oak and pointers?, thence north fifteen West Seventy six poles to a stake on the Pilot Ridge, thence with the top of the said Ridge and with its various meanders to the beginning - containing by estimation Severty five acres be the same more of less. To have and to hold the same to the said Nicholas Everhart and his heirs and assigns forever _ We do covenant with the said Nicholas Everhart that we are lawfully seized of said land and have a good right to convey it, and that the same is unincumbered, we further covenant and bind ourselves our heirs and our Representatives to warrant and forever defend the title to the said land and every part thereof to the said Nicholas Everhart his heirs and assigns forever, aginst the lawful claims of all persons whatever. This day of 1852. Executed and delivered in our presence this 14th day of September 1852.

Greene County } Personally appeared before me Elijah W. Headrick Clerk of the County

Court of said County, V.D. Smith and James D. Kinney, Subscribing Witnesses to the within named deed, who being first sworn, depose and say that they are acquainted with Alexander Hale, John Hale, and Ogburn Hale the bargainors, and that they saw them Sign, Seal and execute the same on the day it bears date. The evidence by V.D. Smith was given on the 18th day of October 1852, and that of James D. Kinney on the 19th day of November 1852. Witness my hand at office, the 19th day of November 1852.
