Whereas
I Charles Bright Executor of Last will and Testament of William Hendry
Decease'd,
did on the 11th day of December, one thousand eight hundred thirty nine by
virtue
of the power in me vested by said last will and Testament of said Decease'd and
by
law
sell by way of public vandue a certain parcel or tract of land, that William
Hendry
decease'd
, died seized and possessed of lying and being in the County of Greene and
State
of
Tennessee on the waters of Lick creek, unto Eli Hendry of Washington County and
State
aforesaid,
for the sum of two hundred and fifty dollars, and the said Eli Hendry Executed
his
note for the same to me with Joseph Hendry his security, and said land
afterwards
being
levied as the property of the said Eli Hendrys on a suit ?Fanbush of Washington
County
and State of Tennessee, and sold at the court House door in Greenville by the
Sheriff
of Greene County and Valentine Sevier became the purchaser, he being the
highest
and
best bidder, and the said Joseph Hendry Redeemed said land from Valentine
Sevier to
secure
himself, And whereas the said Joseph Hendry was compelled to pay to me the said
purchase
money, to wit, the sum of two hundred and fifty dollars as aforesaid, I never
having
Executed a Deed unto the said Eli Hendry, therefore by arrangements made
between
the said Eli Hendry and Joseph Hendry, and the present purchaser Jacob
Everhart,
and by virtue of the power in me vested by the last will and Testament of
William
Hendry deceased convey unto Jacob Everhart for the consideration of the sum of
Two
hundred and fifty dollars to them in hand paid, the said Eli & Joseph
Hendry the
before
named tract of land containing by estimation ninety Eight acres more or less,
lying
in
Greene County, and District No. 11, and bounded as follows--
Beginning at a White oak and spanish oak
his corner, thence north fifty eight poles to a
hickory,
thence west fifteen poles to a stake and white oak thence North, fifty eight
poles to
a white
oak and hickory by a road, thence west ninety one poles to a post oak, thence
South
one
hundred and fifty seven poles to a post oak, thence East one hundred and eleven
poles
to a
stake, thence north thirteen west, twenty three poles to a beech at a spring,
thence
north
through the middle of said spring, twenty East Eighteen poles to a walnut,
thence
west
seven poles to the beginning including his four acres tract to have and to hold
to the
said
Jacob Everhart his heirs and assigns forever, the title to which land I hereby
Bind the
heirs
of the said William Hendry deceased to warrant and defend to the said Jacob
Everhart
and his heirs against the lawful claim of all persons whatever as fully and
Effectively
as they could be bound if the said William Hendry had Executed this Deed
himself
according to the power in me vested --- Given under my hand and seal, this 17th
day of
March one thousand Eight hundred forty nine. }
