BYLAWS

East Texas Council of Governments

As Adopted and Effective 1 February 1996

1. Article I: Name

The name of the Committee shall be the Regional Solid Waste Advisory Committee.

 

2. Article II: Authority

The Texas Natural Resource Conservation Commission (TNRCC) has directed the East Texas Council of Governments (ETCOG) to create and maintain the Regional Solid Waste Advisory Committee as part of the regional solid waste coordination role of ETCOG.

 

3. Article III: Membership

The membership of the committee should reflect a broad diversity of interests in solid waste management. All members of the committee should be willing to make a commitment to attend regular as well as special called meetings, and to contribute meaningfully to the discussion of solid waste management topics. To better ensure that an effective number of people attend each meeting, and that a balance of interests is maintained, the committee shall consist of 25 voting members, as follows:

 

a) At least twelve members should represent the public sector. There should be at least one public sector representative form each of the subregions designated in the regional plan. At least four of the public sector representatives should be elected officials, with the remainder being involved in some aspect of public solid waste management.

b) At least six members should represent the private sector. At least three of the private sector representative should be involved in solid waste collection and/or disposal, with the remainder being involved in any aspect of solid waste management. Private sector representatives should be from different companies.

c) At least three members should represent the general citizenry. At least one of the citizen representatives should be a member of an organized environmental or other group interested in solid waste management, with the remainder having expressed a genuine interest in solid waste management. If more that one citizen representative is a member of an organized group, they should be from different groups.

d) As ex officio (i.e., non-voting) members, the committee should include at a minimum the ETCOG solid waste coordinator, the TNRCC planner assigned to the COG, and designated representative of the TNRCC regional office.

 

4. Article IV: Membership Term

The term of membership on the Committee shall be one year. Members may be reappointed to serve more than one term. Members are expected to attend all meetings of the Committee. If a member is absent for two consecutive meetings without a valid excuse as determined by the Committee Chairperson, he or she shall be considered to have submitted his or her resignation.

5. Article V: Officers

The officers of the Committee shall be Chairperson and Vice-Chairperson. The officers shall be elected from and by the Committee during the first meeting of the Committee. Officers shall serve for a one year period following election. The Chairperson shall preside at all meetings of the Committee and shall be the representative of the Committee in all matters. The Vice-Chairperson shall perform the duties of the Chairperson in his or her absence.

6. Article VI: Meetings

The Committee shall meet at least quarterly of each solid waste management coordination year. Other meetings may be called by the Chairperson or the staff. Notice of meetings shall be mailed to the members at least one week in advance. A quorum shall consist of nine voting members, and no proxy voting shall be allowed. All meetings of the Committee shall be open to the public. At a minimum, a specific time period should be set aside during each meeting for public comment. At a minimum, summary notes should be prepared for each meeting, and an attendance list of both members and guests should be included.

7. Article VII: Activities

The Committee will be given an opportunity to comment on the following prior to submittal to TNRCC (if it is impracticable for the committee to meet to discuss these items, members should be given an opportunity to provide written comments through mail):

 

ETCOG implementation grant application;

Pass-through grant determinations and ETCOG managed cooperative project determinations;

Reviews of TNRCC direct grant applications and permit applications for regional plan consistency; and

Quarterly progress reports.

In general, meetings of the committee should include, but are not limited to, discussion of the following:

 

Status of various solid waste management activities in or affecting the region;

Success or problems experienced by members;

New or proposed solid waste laws or regulations;

Opportunities for grants or cooperative efforts; and

Various issues of interest or concern.

8. Article VIII: Amendments

These bylaws may be amended as follows. The proposed amendments must be within the required Committee parameters established by the TNRCC. The proposed amendments must be passed by a majority vote of the Committee members at any meeting. The proposed amendments should be provided to all Committee members at least one week before such meeting. Finally, the proposed amendments must be approved by the ETCOG Executive Committee.
